This website is operated by LM Apparel, a brand operated by Lilymele Inc. (“LM Apparel”, “we”, “us” or “our”). We offer this website, including all information, tools and services available from it, to you, the user, conditioned on your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including the additional policies referenced here and available by hyperlink. These Terms apply to all users of the site. If you do not agree to these Terms, please do not use the site or our services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

1. Online store terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority and have given consent for any minor dependents to use this site under your supervision.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction, including copyright laws. A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. General conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.

3. Accuracy of information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information.

4. Made-to-order products

LM Apparel products are manufactured to order through third-party print-on-demand production partners. Because each item is produced specifically for your order, production typically takes 2–7 business days before your order ships, and delivery within the United States typically takes another 3–5 business days. We currently ship to addresses within the United States only.

5. Products, colors and sizing

We make every effort to display product colors and designs accurately. Because screens vary and garment-dyed fabrics have natural variation, the actual color of a product may differ slightly from what you see. Garment measurements may vary by up to 1.5–2 inches; please review our size guide before ordering.

We reserve the right to limit sales of our products to any person, geographic region or jurisdiction, to limit quantities, and to discontinue any product at any time. Returns and replacements are governed by our Return & Refund Policy.

6. Pricing, promotions and discount codes

Prices are shown in US dollars and are subject to change without notice. We are not liable to you or any third party for any price change, suspension or discontinuance of the Service.

Discount codes and promotions are subject to the terms shown with each offer. Unless stated otherwise, codes cannot be combined with other discounts, may be limited to one use per customer, may apply only to eligible products, have no cash value and may be changed or ended at any time. If a product is listed at an incorrect price because of an error, we may cancel orders placed at that price and refund any payment.

7. Orders, billing and account information

We reserve the right to refuse or cancel any order you place with us, including orders that appear to be placed by dealers, resellers or distributors. If we change or cancel an order, we will try to notify you using the email or billing address provided at the time the order was made.

You agree to provide current, complete and accurate purchase and account information for all purchases, and to promptly update your account and other information, including your email address, so that we can complete your transactions and contact you as needed.

8. Intellectual property

All designs, artwork, graphics, text, logos, product photos and other content on this site are the property of LM Apparel or its licensors and are protected by copyright, trademark and other intellectual property laws. Purchasing a product gives you the right to wear and enjoy it; it does not grant any right to reproduce, sell or commercially use our designs. You may not copy, print, resell or create derivative works from our designs without our prior written permission.

9. Third-party tools and links

We may provide you with access to third-party tools and links over which we neither monitor nor have any control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, and that any use of third-party tools or websites is entirely at your own risk and subject to the third party's terms.

10. Reviews, comments and submissions

If you send us comments, reviews, suggestions or other materials, you agree that we may use, edit, publish and distribute them in any medium without restriction or compensation. You agree that your submissions will not violate any third-party rights, will not contain unlawful, abusive or obscene material, and will not mislead us or others about your identity. We may, but have no obligation to, remove content we determine is unlawful or objectionable.

Your submission of personal information through the store is governed by our Privacy Policy.

12. Prohibited uses

In addition to other prohibitions in these Terms, you may not use the site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to infringe our or others' intellectual property rights; to harass, abuse or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect personal information of others; to spam, phish or scrape; or to interfere with the security of the Service. We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law, LM Apparel, Lilymele Inc. and our directors, officers, employees, affiliates, agents, contractors, suppliers and service providers shall not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Service or any products purchased from us. In any case, our total liability for any claim related to a product shall not exceed the amount you paid for that product.

15. Indemnification

You agree to indemnify, defend and hold harmless LM Apparel, Lilymele Inc. and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

16. Severability and termination

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall still be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed without affecting the remaining provisions. These Terms are effective unless and until terminated by you or us. You may terminate them at any time by ceasing to use our site.

These Terms and any separate agreements through which we provide you Services shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
